Section 16-1-44 School emergency operation plans. (a)(1) Each local board of education shall
develop and adopt a comprehensive school emergency operations plan for each school under the
authority of the board. (2) The local board or its agent shall examine the conditions and
operations of each school under the authority of the local board to determine hazards to student
and staff safety and shall propose changes, if needed to promote the prevention of dangerous
problems and circumstances. (3) In developing the plan for each school, the local board or
its agent shall involve community law enforcement and safety officials, including community
fire and emergency management assigned to the school. (b)(1) The board shall incorporate into

institutions or organizations; staff training plans; rights of children; licensing and inspection
of food preparation areas; access by law enforcement agencies. (a) Commencing on January 1,
2018, the department shall register any religious, faith-based, or church nonprofit, other
nonprofit, or for profit affiliated youth residential facility, youth social rehabilitation
facility, community treatment facility for youths, youth transitional care facility, long

Section 16-28-17 When child may be taken into custody. It shall be the duty of the attendance
officer, probation officer or other officer authorized to execute writs of arrest to take
into custody without warrant any child required to attend school or be instructed by a private
tutor who is found away from home and not in the custody of the person having charge
