hours who is sufficiently knowledgeable in the correct operation of the tanning devices to
inform and assist each customer in the proper use of the devices. (2) A tanning facility shall
post a warning sign in any area where a tanning device is used. Posting this sign does not
absolve the facility of any liability. The sign shall state: "DANGER, ULTRAVIOLET RADIATION

Section 22-17B-1 Definitions. For purposes of this chapter, the following terms shall have
the following meanings: (1) OPERATOR. A person designated by the tanning facility owner or
tanning device lessee to operate or assist and instruct in the operation and use of the tanning
facility or tanning device. (2) PHOTOTHERAPY DEVICE. Equipment used in the diagnosis or treatment

Section 22-17B-2 Restrictions on use of tanning devices. The use of a tanning device at a tanning
facility in this state is subject to the following restrictions: (1) No person 16 or 17 years
of age shall use a tanning device unless a parent or legal guardian provides written consent
signed at the tanning facility. (2) No person 15 years of age shall use a tanning device unless
a parent or legal guardian provides written consent signed at the tanning facility and the
parent or legal guardian who signed the written consent is present in the facility during

Section 45-37-41.06 Use of tanning device by minors. (a) A tanning facility shall not allow
a minor between the ages of 14 and 17 to use a tanning device, unless the facility has on
file a statement signed by the parent or legal guardian of the minor stating that the parent
or legal guardian has read and understands all warnings the tanning facility is required to
post, consents to the minor using the tanning device, and agrees that the minor will use the
