Section 36-18-37 Immunity from civil liability. (a) Neither the Director of the Alabama Department of Forensic Sciences nor any person designated by the director for the purposes of taking, collecting, storing, analyzing or testing DNA samples shall incur any civil liability when such taking, collecting, storing, analyzing or testing is performed according to rules or regulations promulgated or adopted by the director, and (b) The alleged damage or injury was not caused by willful or wanton conduct by the director or the director's designated person.
