This bill would provide two methods of proving the existence of a common law marriage. This bill would codify the elements required by case law to establish the existence of a common law marriage-capacity and would specify that the parties could prove the existence of a common law marriage by proving the existence of each element by clear and convincing evidence. This bill would also provide that the parties to a common law marriage could prove the marriage by filing a properly executed declaration of common law marriage in the probate office. SB321 SYNOPSIS: Under existing law, persons who are disabled and receive benefits under certain designated federal and state disability programs are eligible to purchase a fishing or hunting license at a reduced cost. A child who was receiving Social Security benefits as a disabled child, but becomes disqualified for the federal disability benefit based on a change in family circumstances, loses eligibility for a disabled fishing or hunting license. This bill would specify that the disabled child as discussed above could continue to purchase a disabled fishing or hunting license until the child is age 21.
