Section 9-7A-2 Definitions. The following terms, whenever used in this chapter, shall have the following respective meanings unless the context clearly indicates otherwise: (1) COMMISSIONER. The Commissioner of the Department of Conservation and Natural Resources. (2) ADMINISTRATOR. The director of the plans and programs of the Department of Conservation and Natural Resources. (3) FUND. The Alabama Recreation Capital Development Assistance Fund. (4) APPLICANT. Any county, or municipality; or state, county or municipal agency having legal authority to hold title to real property, or any combination of the above named entities. (5) RECREATIONAL LAND. Section 9-15-55 Retention by state of title to certain filled lands; rights of access. (a) The state shall retain title to any lands of the state lying seaward of the mean high tide line that are filled in the course of a beach project undertaken by a coastal municipality pursuant to Article 11 of Chapter 47 of Title 11 with the permit of the Commissioner of the Department of Conservation and Natural Resources as provided in Section 9-15-56.
