Section 7-5-110 Warranties. (a) If its presentation is honored, the beneficiary warrants: (1)
to the issuer, any other person to whom presentation is made, and the applicant that there
is no fraud or forgery of the kind described in Section 7-5-109(a); and (2) to the applicant

Section 7-5-116 Choice of law and forum. (a) The liability of an issuer, nominated person,
or adviser for action or omission is governed by the law of the jurisdiction chosen by an
agreement in the form of a record signed or otherwise authenticated by the affected parties
in the manner provided in Section 7-5-104 or by a provision in the person's letter of credit,
confirmation, or other undertaking. The jurisdiction whose law is chosen need not bear any

Section 13A-9-14.1 Fraud by persons authorized to provide goods and services; definitions.
(a) Definitions. - For purposes of this section, the following terms shall have the meanings

Section 13A-9-14 Illegal possession or fraudulent use of credit card or debit card. (a) A person
commits the crime of illegal possession of a credit or debit card if, knowing that he or she
does not have the consent of the owner, he or she takes, exercises control over, or otherwise
uses the card. (b) A person commits the crime of fraudulent use of a credit card or debit
card if he or she uses, attempts to use, or allows to be used, a credit card or debit card
for the purpose of obtaining property, services, or anything else of value with knowledge
that: (1) The card is stolen; or (2) The card has been revoked or cancelled; or (3) For any
other reason the use of the card is unauthorized by either the issuer or the person to whom
