Section 13A-8-140 Elements of offense of theft by fraudulent leasing or rental. The crime of
theft by fraudulent leasing or rental of property is committed if a person, herein called
"lessee", signs a written lease or rental contract with a person licensed to rent
or lease tangible personal property under the provisions of Article 4, Chapter 12, Title 40,
herein called "lessor", and obtains or exerts control over tangible personal property
by reason of such rental contract, with the intent, knowledge or expectation that he will
not perform the terms, covenants and agreements of the lessee provided in such rental contract.

Section 7-2A-219 Risk of loss. (1) Except in the case of a finance lease, risk of loss is retained
by the lessor and does not pass to the lessee. In the case of a finance lease, risk of loss
passes to the lessee. (2) Subject to the provisions of this article on the effect of default
on risk of loss (Section 7-2A-220), if risk of loss is to pass to the lessee and the time

Section 7-2A-221 Casualty to identified goods. If a lease contract requires goods identified
when the lease contract is made, and the goods suffer casualty without fault of the lessee,
the lessor or the supplier before delivery, or the goods suffer casualty before risk of loss

Section 7-1-203 Lease distinguished from security interest. (a) Whether a transaction in the
form of a lease creates a lease or security interest is determined by the facts of each case.
(b) A transaction in the form of a lease creates a security interest if the consideration
that the lessee is to pay the lessor for the right to possession and use of the goods is an

Section 7-2A-402 Anticipatory repudiation. (1) If either party repudiates a lease contract

Section 7-2A-511 Merchant lessee's duties as to rightfully rejected goods. (1) Subject to any
security interest of a lessee (Section 7-2A-508(5)), if a lessor or a supplier has no agent
or place of business at the market of rejection, a merchant lessee, after rejection of goods

Section 37-9-23 Certificates for common carriers and permits for contract carriers - Transfer
