Section 45-49-40.11 Examinations. The following are exempted from this part: (1) Persons licensed
by law of this state to practice medicine, surgery, osteopathy, or chiropractic. (2) Commissioned
medical or surgical officers of the United States Army, Air Force, Navy, or Marine hospital
service. (3) Registered nurses. (4) Hairdressers and beauty culturists, insofar as their usual
and ordinary vocation and profession is concerned, including light hair trimming incidental
to waving of all kinds. (5) Undertakers and morticians. (6) All barber schools and colleges

Section 34-40-9 Professions and occupations not affected; chapter not applicable to certain
persons. (a) Nothing in this chapter shall be construed as preventing or restricting any of
the following persons from engaging in the profession or occupation for which they are licensed,
certified, or registered in Alabama as follows: (1) Physicians and surgeons licensed by the
Medical Licensure Commission of Alabama. (2) Dentists licensed by the State Board of Dental
Examiners. (3) Optometrists licensed by the State Board of Optometry. (4) Nurses licensed
by the Alabama Board of Nursing. (5) Chiropractors licensed by the State Board of Chiropractic

Section 34-5-3 Exemptions from chapter. Any person who can establish within six months after
August 19, 1971, that he or she is a barber or an apprentice as defined under this chapter
and can establish reasonable proof that he or she is practicing barbering in a barbershop
under sanitary conditions will be given a certificate to practice barbering or an apprentice
certificate without any examination upon paying the required fees as prescribed by this chapter.
This section will not be construed to mean anyone except the barbers now practicing in the
State of Alabama and instructors in barber colleges under the state vocational schools. The
following persons are specifically exempt from the provisions of this chapter while in the
proper discharge of their professional duties: (1) Persons authorized by law to practice medicine
or surgery; (2) Commissioned medical or surgical officers of the Armed Forces of the United
States; (3) Registered nurses; and (4) Persons authorized by law to...
