Section 45-45-170.01 Regulation of dogs or other animals running at large. The Madison County
Commission shall have the power by ordinance to regulate and prevent within Madison County
the running at large of all dogs or other animals and to pass all ordinances necessary for
the impounding and sale of such dogs and destruction of dogs, so long as any ordinances are
not inconsistent with Section 45-45-170 and no such ordinance shall permit the impounding
of dogs which have a current Madison County license and a current inoculation for rabies unless
the Madison County Commission has received a complaint regarding the dog running at large.

cities and towns of this state shall have the power to regulate and prevent the running at

Section 3-1-5 Permitting dogs to run at large; applicability of provisions of section in counties
and certain cities or towns. (a) Every person owning or having in charge any dog or dogs shall
at all times confine such dog or dogs to the limits of his own premises or the premises on
which such dog or dogs is or are regularly kept. Nothing in this section shall prevent the

Section 11-3A-2 Powers for public welfare, health, and safety; authorization; scope. (a) Except
where otherwise specifically prohibited or provided for either heretofore or hereafter by
general law or the constitution of this state and subject to the procedures and limitations

Section 32-1-1.1 Definitions. The following words and phrases when used in this title, for
the purpose of this title, shall have meanings respectively ascribed to them in this section,
except when the context otherwise requires: (1) ALLEY. A street or highway intended to provide

Section 3-5-4 Taking up of livestock or animals running at large by highway patrol, etc.; notification
of owner thereof generally. Any state trooper, the sheriff and his deputies of any county,
or the constable of any precinct or any law enforcement officer of any municipality shall

Section 45-45-174 Noise control. (a) In Madison County, the Madison County Commission may enact
a noise ordinance for the areas outside of the corporate limits of any municipality and may
provide that a violation of the ordinance constitutes a public nuisance subject to a civil
fine of not more than one thousand dollars ($1,000) per day to be assessed as provided in
the ordinance. Any law enforcement officer or constable may issue a citation alleging a violation
of the ordinance. The ordinance may provide that the person charged with a violation may pay
a civil fine or request, within 30 days of receipt of the citation, a due process hearing
before the Madison County Commission or a hearing officer designated by the Madison County
Commission on the validity of the citation. An order of the Madison County Commission finding

Section 45-45-244 Authorization; resolution. (a) The Madison County Commission, by resolution
