Section 45-44-247.05 Collection and enforcement. The tax levied by this part shall constitute
a debt due Macon County. The tax, together with any interest and penalties, shall constitute
and be secured by a lien upon the property of any person from whom the tax is due or who is
required to collect the tax. The county shall collect the tax and enforce this part and shall
have and may exercise all rights and remedies otherwise currently applicable or which may
be provided for in the future for the collection of the sales and use taxes in the county.

Section 11-65-3 Class 1 municipality authorized to create racing commission; status of commission;
powers and duties generally; disposition of fees; jurisdiction of State Ethics Commission.
A commission is authorized to be created in accordance with the provisions of this chapter
for each Class 1 municipality, as Class 1 municipality is defined in Section 11-40-12 or any
successor provision of law. Any commission created for any sponsoring municipality pursuant

Section 11-65-16 Review of application for horse racing facility license. (a) A commission
shall promptly consider any application for the issuance or transfer of a horse racing facility
license submitted to it and shall grant or deny the issuance or transfer of such license based
on all information before it, including the results of investigations it deems appropriate.
A commission shall deny the issuance of an original horse racing facility license to any applicant
unless it finds that the applicant's facility will meet the following minimum standards: (1)
That the facilities will provide a track racing surface of at least one mile; (2) That the

Section 11-65-34 Horse breeding fund. Each commission shall establish a special fund to promote
the breeding, raising, and racing of horses in the state, which shall be known as "The
___ [name of the sponsoring municipality] Racing Commission Breeding and Development Fund."

Section 45-44-170.04 Licensing and operation of junkyards. (a) No person shall establish, operate,
or maintain a junkyard containing any items listed in Section 45-44-170.01, but not limited
to those items any portion of which is within 1,000 feet of the nearest edge of the right-of-way

Section 45-49-151.01 Qualifications of members. (a) The members of the commission shall be
qualified electors not less than 19 years of age, who shall have resided in the county for
the period of five years next preceding their appointment. Each commissioner shall take the

Section 45-49-151.09 Application for permit or license. (a) On or before the 15th day of October
of each year, any person, association, or corporation possessing the qualifications prescribed
in this subpart may apply to the racing commission for a permit or license to conduct race
