Section 10A-20-16.02 Definitions. The following terms shall have the following respective meanings
for the purposes of this chapter: (1) OFFICER. Any officer, director, trustee, partner, manager,
member, and governing person and other member of the governing authority of a qualified entity
who does not receive compensation for serving in such capacity. A per diem amount of not more
than three hundred dollars ($300) per day and actual, reasonable, and necessary expenses shall
not constitute compensation for the purposes of this article. Provided, however, that the
immunity granted herein shall not extend to officers, directors, trustees, partners, managers,

Section 11-43A-84 Appointment of city manager; temporary acting city manager; term of city
manager; removal; actions by council or its members prohibited or restricted. (a) The council,
by a majority vote of the whole qualified membership of the council, shall appoint a city
manager who shall be an officer of the city and shall have the powers to perform the duties

Section 9-16-82 Permits - Required; term; successor in interest; termination; renewal; application.
(a) No person shall engage in surface coal mining operations at a particular location except
as a subcontractor of the permittee of that location until such person has been issued a permit
by the regulatory authority for that location in accordance with the provisions of this section.
The term of a permit shall not exceed five years and shall authorize the permittee to engage
in surface coal mining operations within the permitted area, unless sooner suspended or revoked
in accordance with the provisions of this article. However, if the applicant demonstrates
that a specified longer term is reasonably needed to allow the applicant to obtain the necessary
financing for equipment and the opening of the operation and that the application is full
