Section 45-41A-40.08 Powers of the authority. (a) The authority shall have all of the following
powers, together with all powers incidental thereto or necessary to the discharge thereof
in corporate form: (1) To have succession by its corporate name for the duration of time which
may be perpetuity, subject to Section 45-41A-40.19, specified in its certificate of incorporation.
(2) To sue and be sued in its own name and to prosecute and defend civil actions in any court

Section 32-1-1.1 Definitions. The following words and phrases when used in this title, for
the purpose of this title, shall have meanings respectively ascribed to them in this section,
except when the context otherwise requires: (1) ALLEY. A street or highway intended to provide

Section 45-2-222 Lease of oil, gas, and mineral rights. (a) On roads where Baldwin County owns
the oil, gas, and mineral rights, the Baldwin County Commission is authorized to lease the
oil, gas, and mineral rights on the right-of-way of the county roads on a competitive basis
in the same manner as provided by the competitive bid laws applying to county purchases. (b)(1)
