The owner of a dog that has been declared to be dangerous or a nuisance by a court may petition the district court to remove the dangerous or nuisance dog designation 18 months after the judicial declaration was issued. A copy of the petition shall be filed with the district attorney. The court may remove the dangerous or nuisance dog designation and eliminate any requirements of this part if the owner of the dog has not violated this part and any orders of the court, and if the court is satisfied from the evidence that the dog is no longer dangerous. (a) The law enforcement officer or any agent of the county or of the municipality, without the requirement of any fee or charge for court costs, shall immediately petition the municipal court if the violation involves a municipal ordinance or the district court in the county in which the dog or cat is found for a hearing to be set within 20 days of seizure of the dog or cat or issuance of the order to provide care.
