Section 37-3-7 Powers and duties of commission generally. It shall be the duty of the commission:
(1) To regulate common carriers by motor vehicle as provided in this chapter, and, to that
end, the commission may establish reasonable rules and requirements with respect to adequate
service, transportation of passengers, baggage, freight and express, uniform systems of accounts,
records and reports, preservation of records, qualifications and maximum hours of service
of employees and safety of operation and equipment. (2) To regulate contract carriers by motor
vehicle as provided in this chapter, and, to that end, the commission may establish reasonable

Section 7-7-309 Duty of care; contractual limitation of carrier's liability. (a) A carrier
that issues a bill of lading, whether negotiable or nonnegotiable, shall exercise the degree
of care in relation to the goods which a reasonably careful person would exercise under similar
circumstances. This subsection does not affect any statute, regulation, or rule of law that
imposes liability upon a common carrier for damages not caused by its negligence. (b) Damages
may be limited by a term in the bill of lading or in a transportation agreement that the carrier's
liability may not exceed a value stated in the bill or transportation agreement if the carrier's
rates are dependent upon value and the consignor is afforded an opportunity to declare a higher

Section 37-3-11 Certificate of public convenience and necessity - Issuance generally. (a) Subject
to the provisions of Section 37-3-14 and to the provisions of subsection (b), a certificate

Section 37-3-13 Contract carrier permits - Generally. (a) No person shall engage in the business
of a contract carrier by motor vehicle in intrastate commerce on any highway of this state
unless there is in force with respect to such carrier a permit issued by the commission, authorizing
