Section 37-16-2 Legislative findings. (a) The Legislature finds and declares the following:
(1) More advanced communication capabilities, broadband facilities, and services are needed
in many rural and underserved areas of the state. (2) Electric providers in those rural and
underserved areas are capable of providing infrastructure for such advanced communications
capabilities and providing, directly or indirectly, broadband facilities or services. (3)
The investment in and development of advanced communications capabilities for providing broadband
facilities and services are necessary to better serve the public in those rural and underserved
areas. (4) The continued lack of advanced communication capabilities, broadband facilities,
and services in rural and underserved areas deprives citizens residing in these areas from
access to opportunities such that the state needs to take action to correct and eliminate

Section 41-23-213 Grant program; rulemaking authority; Alabama Broadband Accessibility Fund.
(a) The Director of ADECA may establish and administer the broadband accessibility grant program
for the purpose of promoting the deployment and adoption of broadband Internet access services
to unserved areas. By June 26, 2018, the director shall adopt rules and policies to administer
the program and begin to accept applications for grants, and shall adopt such rules as may
be necessary to meet the future needs of the grant program. (b) The program shall be administered
pursuant to policies developed by ADECA in compliance with this article. The policies shall
provide for the awarding of grants to non-governmental entities that are cooperatives, corporations,
limited liability companies, partnerships, or other private business entities that provide

Section 16-46B-3 Funding for teacher professional learning programs. (a) Subject to appropriation
from the Legislature, funds shall be appropriated to the department and the department shall
allocate those funds to eligible entities to develop and implement teacher professional learning
programs for the required computer science courses and content. (b) For the purposes of this
section, eligible entities shall include high quality computer science professional learning
providers, including institutions of higher education physically located in the state, nonprofits
dedicated to providing high quality computer science professional learning as determined by

Section 37-16-4 Powers of electric providers; access to broadband system; rate methodology
and terms of access; limitations; annual report. (a) To the extent not otherwise authorized
by law, and in addition to all other purposes, powers, and authority currently granted to
electric providers under the laws of this state, an electric provider may do all of the following:
(1) Own, operate, maintain, construct, install, and replace a broadband system on, over, under,
or across the electric provider's electric easements, whether used for or supporting utility

Section 37-6-42 Enumerated powers. (a) Any such electric cooperative shall have power: (1)
To supply telephone service in rural areas to its members, to governmental agencies and political
subdivisions, to other persons, and to business entities not in excess of 40 percent of the

limitation, services classified as of January 1, 1997, as "commercial mobile radio services"

Section 37-16-3 Definitions. As used in this chapter, the following terms shall have the following
meanings: (1) ADVANCED COMMUNICATIONS CAPABILITIES. The communications capabilities defined
from time to time as advanced telecommunications capabilities by the Federal Communications
Commission (FCC) through regulations, statutes, or other written guidance or orders. The term

Section 41-23-153 Establishment and administration of financing program. (a) The department,
in cooperation with public and private sector partners, shall establish a financing program
to provide financing to retailers to construct, rehabilitate, or expand grocery stores in
underserved communities in urban and rural low and moderate income areas. (b) The department
may contract with one or more qualified nonprofit organizations or community development financial
institutions to administer this program through a public-private partnership. The department

certificate of need requirement. (a) The Legislature hereby finds and declares that it is
in the best interest of the state and its residents for kidney disease treatment centers to
be established and operated throughout the state so that any patient needing such treatment
will be able to utilize a hemodialysis unit located within a reasonable distance from his

Section 11-98-4.1 Board created; composition; powers and duties. (a) There is created a statewide
911 Board comprised of 13 members that shall reflect the racial, gender, geographic, urban/rural,
and economic diversity of the state. All appointing authorities shall coordinate their appointments
so that diversity of gender, race, and geographical areas is reflective of the makeup of this
