Section 11-51-90.2 Purchase of business license; classification of taxpayers; vehicle decals;
determination of gross receipts; construction with other provisions. (a) Every taxpayer required
to purchase a business license under this chapter shall: (1) Purchase a business license for
each location at which it does business in the municipality, except as otherwise provided
by the municipality. (2) Except as provided in Section 11-51-193, with respect to taxpayers
subject to state licensing board oversight, be classified into one or more of the following
2002 North American Industrial Classification System ("NAICS") sectors and applicable

Section 40-23-4 Exemptions. (a) There are exempted from the provisions of this division and
from the computation of the amount of the tax levied, assessed, or payable under this division
the following: (1) The gross proceeds of the sales of lubricating oil and gasoline as defined
in Sections 40-17-30 and 40-17-170 and the gross proceeds from those sales of lubricating
oil destined for out-of-state use which are transacted in a manner whereby an out-of-state
purchaser takes delivery of such oil at a distributor's plant within this state and transports
it out-of-state, which are otherwise taxed. (2) The gross proceeds of the sale, or sales,
of fertilizer when used for agricultural purposes. The word "fertilizer" shall not
be construed to include cottonseed meal, when not in combination with other materials. (3)
The gross proceeds of the sale, or sales, of seeds for planting purposes and baby chicks and

Section 32-9A-2 Compliance with Federal Motor Carrier Safety Regulations; in-service training
by law enforcement officers. (a)(1) Except as otherwise provided in subsection (b), no person
may operate a commercial motor vehicle in this state, or fail to maintain required records
or reports, in violation of the federal motor carrier safety regulations as prescribed by
the U.S. Department of Transportation, 49 C.F.R. Part 107, Parts 171-180, Parts 382-387, and

Section 32-6-49.7 Commercial driver license required; exceptions. (a) Except when driving with
a commercial driver license learner's permit and accompanied by the holder of a commercial
driver license valid for the vehicle being driven, no person may drive a commercial motor
vehicle on the highways of this state unless the person holds, and is in immediate possession
of, a commercial driver license with applicable endorsements valid for the vehicle he or she
is driving. Active duty military or National Guard personnel operating government vehicles,
farmers operating certain commercial motor vehicles, firefighters and operators of emergency

Section 32-9B-3 Automated commercial vehicles - Operation without presence of conventional
driver. Notwithstanding any other provision of law, an automated commercial motor vehicle
may operate in this state without a conventional driver physically present in the vehicle
if the vehicle meets all of the following criteria: (1) The automated commercial vehicle is
capable of operating in compliance with applicable federal law and the traffic and motor vehicle
laws of this state, including without limitation, applicable laws concerning the capability

Section 32-9B-7 Teleoperation systems; Requirements. A commercial motor vehicle equipped with
a teleoperation system registered in this state shall meet all of the following requirements:
(1) Is in compliance with applicable federal law. (2) Is certified in accordance with federal

Section 32-5-192 Implied consent; when tests administered; suspension of license or permit
to drive, etc., for refusal to submit to test. (a) Any person who operates a motor vehicle
upon the public highways of this state shall be deemed to have given his consent, subject
to the provisions of this division, to a chemical test or tests of his blood, breath or urine
for the purpose of determining the alcoholic content of his blood if lawfully arrested for
any offense arising out of acts alleged to have been committed while the person was driving
a motor vehicle on the public highways of this state while under the influence of intoxicating
