Section 28-1-8 Powdered alcohol. (a) For purposes of this section, "powdered alcohol" is alcohol sold in a powder or crystalline form, for either direct use or reconstituted with any liquid or food. (b) It shall be unlawful for any person or business establishment to possess, purchase, sell, offer to sell, or use powdered alcohol. (c) This section shall not apply to a hospital that operates primarily for the purpose of conducting scientific research, a state institution, a pharmaceutical company, or a biotechnology company conducting bona fide research. (d) A person or business establishment who unlawfully possesses, purchases, or uses a powdered alcohol product shall be fined as provided in a Class A misdemeanor for the first offense. (e) A person or business establishment who unlawfully sells or offers to sell a powdered alcohol product shall be guilty of a Class A misdemeanor, and on a second or subsequent conviction, shall be guilty of a Class D felony.
