A domestic mutual insurer, after being authorized to transact one kind of insurance, may be
authorized by the commissioner to transact such additional kinds of insurance as are permitted
under Section 27-3-6, while otherwise in compliance with this title and while maintaining
unimpaired surplus funds in an amount not less than the amount of paid-in capital stock required
of a domestic stock insurer transacting like kinds of insurance, subject further to the additional

Section 27-27-34 Nonassessable policies in mutual insurers - Generally. (a) While possessing
surplus funds in amount not less than the paid-in capital stock required of a domestic stock

Section 27-27-38 Dividends - Domestic mutual insurers. (a) The directors of a domestic mutual
insurer may, from time to time, apportion and pay or credit to its members dividends only
out of that part of its surplus funds which represents net realized savings and net realized
earnings in excess of the surplus required by law to be maintained. (b) A dividend otherwise
proper may be payable out of the savings and earnings even though the insurer's total surplus
is then less than the aggregate of its contributed surplus if payment is conditioned upon

to an assuming insurer not meeting the requirements of Sections 27-5B-3 through 27-5B-13.
An asset or a reduction from liability for the reinsurance ceded by a domestic insurer to

Section 27-27-36 Issuance of participating or nonparticipating policies by domestic insurers.
Unless prohibited by its articles of incorporation, a domestic stock or domestic mutual insurer
may issue any, or all, of its policies with, or without, participation in profits, savings,
or unabsorbed portions of premiums, may classify policies issued on a participating and nonparticipating
basis, and may determine the right to participate and the extent of participation of any class,
or classes, of policies. Any such classification or determination shall be reasonable and
shall not unfairly discriminate as between policyholders within the same such classifications.

Section 27-27-39 Dividends - Liability for illegal dividends by domestic insurers. (a) Any
director of a domestic stock or mutual insurer who knowingly votes for, or concurs in, declaration
or payment of a dividend to stockholders or members except as authorized in Sections 27-27-37

Section 27-5B-10 Reinsurer not licensed, accredited or certified - Additional reinsurance agreement
requirements. (a) If the assuming insurer is not licensed, accredited or certified to transact

Section 27-5B-5 Accredited reinsurer. Credit shall be allowed when the reinsurance is ceded
to an assuming insurer that is accredited by the commissioner as a reinsurer in this state.
In order to be eligible for accreditation, a reinsurer must do all of the following: (1) File
