Section 25-4-113 Employees; immunity from civil suit; exception. The secretary shall, with
the approval of the Governor, determine the number of employees needed for the efficient and
economical performance of the functions and duties of administering this chapter. All positions
in the administration of this chapter shall be filled subject to the provisions of the Merit
System. The minimum standards that may be prescribed by the United States Secretary of Labor
or his successor with respect to the selection and classification of officers and employees
engaged in the performance of any of the functions and duties of the Department of Labor having
to do with the administration of this chapter in this state shall be observed. The secretary
shall fix the duties and powers of all persons thus employed, and may authorize any such person
to do any act or acts which could lawfully be done by the secretary. The secretary, his employees

Section 41-23-5 Establishment of divisions; appointment of division chiefs; oath of office;
restrictions on employment; directors of merged agencies abolished; purpose of chapter. (a)
The Director of the Department of Economic and Community Affairs, with the approval of the
Governor, may establish such division or divisions as may, in his discretion, be reasonably
necessary for the administration and enforcement of any law, rule or regulation with which
the department is charged or the performance of any of its functions or duties. Each division
in the department shall be headed by and be under the direction, supervision and control of

Section 11-52-6 Municipal Planning Commission - Powers and duties generally. (a) In general,
the commission shall have such powers as may be necessary to enable it to fulfill its functions,

Section 11-93-1 Definitions. For the purposes of this chapter, the following terms shall have
the meanings ascribed to them by this section: (1) GOVERNMENTAL ENTITY. Any incorporated municipality,
