Section 22-17A-3 Tattoo facility license. (a) A person shall not tattoo, brand, or perform body piercing on another individual unless each of the following conditions is met: (1) The tattooing, branding, or body piercing occurs at a tattoo facility licensed under this chapter. (2) The individual receiving the tattoo, branding, or body piercing is 18 years of age or older. (b) The owner or operator of a tattoo facility may apply to the department for a tattoo facility license under this chapter on a form provided by the department, and at the time of application shall pay to the department the appropriate fee under subsection (c). Section 22-8A-8 Refusal of health care provider to comply; penalties. (a) A health care provider who refuses to comply with a living will or the directions of a duly designated proxy or a duly appointed surrogate or who refuses to honor a portable physician DNAR order executed in compliance with the directives of this chapter and using the form designated by the State Board of Health pursuant to this chapter shall promptly so advise the declarant and any individual designated to act for the declarant, shall not be liable for such refusal, but shall permit the patient to be transferred to another health care provider. (a) In accordance with the Alabama Administrative Procedure Act, the board, with the advice and after approval of the council, shall promulgate rules to implement and administer this chapter.
