Section 16-13B-2 Exceptions to competitive bidding requirements. (a) Competitive bids shall
not be required for utility services for county or city boards of education, the rates for
which are fixed by law, regulation, or ordinance, and the competitive bidding requirements
of this chapter shall not apply to: (1) The purchase of insurance. (2) Contracts for securing
services of attorneys, physicians, architects, teachers, superintendents of construction,
artists, appraisers, engineers, consultants, certified public accountants, public accountants,
or other individuals possessing a high degree of professional skill where the personality

Section 39-2-2 Advertisement for and opening of sealed bids for public works contracts; violations;
exclusions; emergency actions; sole source specification. (a) Before entering into any contract
for a public works involving an amount in excess of fifty thousand dollars ($50,000), the
awarding authority shall advertise for sealed bids, except as provided in subsection (j).

Section 40-23-4 Exemptions. (a) There are exempted from the provisions of this division and
from the computation of the amount of the tax levied, assessed, or payable under this division

Section 41-16-21.1 Joint purchasing agreements. (a) In the event that utility services are
no longer exempt from competitive bidding under this article, non-adjoining counties may not
purchase utility services by joint agreement under authority granted by this section. (b)(1)
