Section 11-40-83 Zoning authority in overlapping police jurisdictions - Zoning disputes between municipalities. Notwithstanding Section 11-40-82, in the overlapping areas of the police jurisdiction of the municipalities, each municipality may object to a zoning decision of the other municipality in the overlapping areas. In that case, the objecting municipality shall notify the other municipality of its objection and the zoning dispute shall be resolved by a panel consisting of the mayors of the two municipalities and the chair of the county commission of the county where the property involved in the zoning dispute is located. If the planned expansion of a municipal police jurisdiction includes any portion of the Turnerville fire protection district, the owners of property located and contained within the affected area may approve the expansion by petition. (a)(1) With respect to those municipalities and counties for which the department serves as the collecting sales tax agent from time to time, when the total state sales tax for which any person is liable under Chapter 23 of Title 40 averages less than two hundred dollars ($200) per month during the preceding calendar year, a quarterly sales tax return and remittance in lieu of monthly returns may be made to the department.
