Section 41-27-42 Assessment of penalties for noncompliance. (a) If the agency determines that the motor vehicle the driver was driving at the time of the motor vehicle incident was not in compliance, the agency shall issue the assessment of a civil penalty in the amount of two hundred dollars ($200) for the first offense, three hundred dollars ($300) for a second offense, and four hundred dollars ($400) for a third or subsequent offense against the driver for failure to comply with the Mandatory Motor Vehicle Liability Insurance Law unless the motor vehicle is owned by any person, firm, association, or corporation licensed and engaged in the business of renting or leasing motor vehicles. Section 32-7C-33 Recordkeeping; inspection; audit analysis; disclosure of information. (a) A TNC shall maintain the following records: (1) Individual trip records for at least two years from the date each trip was provided. (2) Individual records of TNC drivers at least two years from the date on which a TNC driver's relationship with the TNC ended. (b) For the sole purpose of verifying that a TNC is in compliance with subsection (a) and Section 32-7C-29 and no more than annually, the commission may visually inspect a random sample of the records that the TNC is required to maintain pursuant to subsection (a). Section 32-7-35 Assigned risk plans. After consultation with insurance companies authorized to issue automobile liability policies in this state, the Commissioner of Insurance shall approve a reasonable plan or plans for the equitable apportionment among such companies of applicants for such policies and for motor vehicle liability policies who are in good faith entitled to but are unable to procure such policies through ordinary methods. When any such plan has been approved, all such insurance companies shall subscribe thereto and participate therein.
