Section 9-16-14 Applicability of provisions of article. The provisions of this article
shall not apply to surface mining activities of the State Department of Transportation or
any city, county or municipality incident to their activities in constructing, repairing and
maintaining the public road system in Alabama. The provisions of this section shall
also extend to any person, firm or corporation contracting with the State Department of Transportation
or any city, county or municipality to construct, repair and maintain public roads; provided,
that such contracts contain standards for the reclamation of all affected surface mining areas;

Section 23-1-40 Duties and powers generally. (a) It shall be the duty of the Department
of Transportation to designate the roads to be constructed, repaired, and maintained and to
construct, standardize, repair, and maintain roads and bridges of this state; and it shall

Section 40-17-350 Transportation of motor fuel; inspections. (a) Each person operating
a refinery or terminal in Alabama shall prepare and provide to the driver of every highway
vehicle receiving motor fuel at the facility a shipping document setting out on its face the
destination state as represented to the terminal operator by the shipper or the shipper's
agent. Failure to comply with this subsection may result in a department imposed penalty of
not less than five hundred dollars ($500) nor more than one thousand dollars ($1,000), to
be multiplied by the sum of the current violation plus prior violations of this subsection.
(b) Every person transporting motor fuel in Alabama in a highway vehicle other than in its
supply tank shall carry on board a shipping document issued by the facility where the motor

Section 39-2-12 Partial and final payments of contractors by awarding authorities. (a)
As used in this section the following words shall have the meanings ascribed to them
as follows: (1) CONTRACTOR. Any natural person, partnership, company, firm, corporation, association,
