Section 41-17A-2 Definitions. As used in this chapter the following terms shall have the following
meanings: (1) FUEL ECONOMY. The applicable model year combined highway/city fuel economy with
respect to a vehicle as determined on a gasoline gallon equivalent basis as determined by
the Administrator of the U.S. Environmental Protection Agency with respect to the vehicle.
If such data is not available from the administrator, the fuel economy shall be the total
in-use fuel consumed divided by the total miles driven for the most recent fiscal year. (2)
HEAVY DUTY VEHICLE. Any motor vehicle, licensed for use on roadways, having a manufacturer's
gross vehicle weight rating greater than 14,000 pounds. (3) LIGHT DUTY VEHICLE. Any motor
vehicle designed primarily for the transportation of persons and with a manufacturer's gross
vehicle weight rating of 8,500 pounds or less. (4) MEDIUM DUTY VEHICLE. Any vehicle having

Section 8-22-5 Oil transfer price disclosure required. All persons engaged in commerce in this
state are required to disclose, upon request, their transfer prices on each grade of motor
fuel transferred or sold to itself or an affiliate for resale at another marketing level of

Section 7-2-706 Seller's resale including contract for resale. (1) Under the conditions stated
in Section 7-2-703 on seller's remedies, the seller may resell the goods concerned or the
undelivered balance thereof. Where the resale is made in good faith and in a commercially
reasonable manner the seller may recover the difference between the resale price and the contract
price together with any incidental damages allowed under the provisions of this article (Section
7-2-710), but less expenses saved in consequence of the buyer's breach. (2) Except as otherwise
provided in subsection (3) or unless otherwise agreed resale may be at public or private sale
including sale by way of one or more contracts to sell or of identification to an existing

Section 8-22-18 Prima facie showing of violation of chapter. In any action brought under Sections
8-22-15, 8-22-16 or 8-22-17, upon a prima facie showing of a violation, the burden of rebutting
the prima facie case thus made by showing justification shall shift to the defendant. A prima
facie showing of a violation shall be constituted if the plaintiff shows: (1) That the plaintiff's
purchase price from a refiner or wholesaler is greater than said refiner's transfer price;
or (2) That the plaintiff's purchase price from a refiner or wholesaler plus the plaintiff's
cost of doing business is greater than said refiner's or wholesaler's retail posted sales
price; or (3) That the plaintiff's basic cost of motor fuel plus the plaintiff's cost of doing
business is greater than the posted sales price at a retail location of a competitor, within
the plaintiff's marketing area, suspected of selling motor fuel in violation of this chapter.

Section 40-17-322 Definitions. As used in this article and unless the context requires otherwise,
the following terms have the meaning ascribed herein: (1) AIRCRAFT. Any airplane or helicopter.

Section 22-35-3 Definitions. For the purposes of this chapter, unless otherwise indicated,
the following terms shall have the meanings respectively ascribed to them by this section:
(1) ABOVEGROUND STORAGE TANK. Any one or combination of stationary tanks affixed permanently
to the ground or other support structure (including pipes connected thereto) used to contain
an accumulation of motor fuels, the volume of which (including pipes connected thereto) is
greater than 90 percent above the surface of the ground. The terms "Underground Storage

Section 40-17-335 Surety bond. (a) Upon approval of the application by the department, the
applicant shall file with the department a surety bond as herein provided: (1) Except as provided
under subdivision (3), the bond amount for an applicant for a license as a supplier, permissive
supplier, or terminal operator shall be in the approximate amount of twice the average monthly
tax liability, not to exceed two million dollars ($2,000,000). (2) Except as provided under

Section 28-7-16 Tax on sale of table wine; disposition of proceeds. (a) Levy. There is hereby
levied in addition to the license taxes provided for by this chapter and municipal and county
license taxes and in addition to any marked-up price made by the board on wine sold by the
