Section 37-9-23 Certificates for common carriers and permits for contract carriers - Transfer
or lease. Any certificate or permit may be transferred or leased subject to the approval of
the commission and under such rules and regulations as may be prescribed by the commission.
Except where a transfer of a certificate or a permit results from the operation of law, approval
of such transfer or lease shall be given only upon a finding by the commission, after notice
and opportunity for a hearing, that such transfer or lease will be consistent with the public
interest. The application for approval shall be made jointly by the transferor and the transferee
or lessor and lessee. No value shall be allowed for any purpose for any certificate or permit

Section 6-6-314 Liability of lessee holding over; how such recovered. Any person who, having
entered into the possession of lands and tenements under a contract of lease, forcibly or
unlawfully retains the possession thereof after the expiration of his term or refuses to surrender
the same on the written demand of the lessor, his agent, or attorney or legal representative,
is liable for double the amount of the annual rent agreed to be paid under such contract and

Section 45-37-244.01 Automobile rental tax. (a) In Jefferson County, in addition to all other
taxes imposed by law, there is hereby levied an additional privilege or license tax, in the
amount hereinafter prescribed against any person, organization, or other entity engaging or
continuing in the county in the business of leasing or renting any passenger automotive vehicle,
the duration of the lease being not more than one year. The amount of the taxes levied by
this section shall be equal to three percent of the gross proceeds derived by the lessor from
the lease or rental of such passenger automotive vehicle for not more than one year. The taxes

provided in subsection (c), for purposes of determining the priority of a perfected security

Section 23-2-171 Defense against liability. The owner of the motor vehicle involved in the
violation is responsible and liable for payment of a citation issued for failure to pay a
toll, unless: (1) The owner can establish that the motor vehicle was stolen at the time of
the violation. In order to establish such facts, the owner of the motor vehicle is required
to furnish the court with a police report indicating that the vehicle was stolen at the time
