Section 8-1A-9 Attribution and effect of electronic record and electronic signature. (a) An
electronic record or electronic signature is attributable to a person if it was the act of
the person. The act of the person may be shown in any manner, including a showing of the efficacy
of any security procedure applied to determine the person to which the electronic record or

Section 10A-9A-1.02 Definitions. Notwithstanding Section 10A-1-1.03, as used in this chapter,
unless the context otherwise requires, the following terms mean: (1) "CERTIFICATE OF
FORMATION" with respect to a limited partnership means the certificate of formation required
by Section 10A-9A-2.01, and the certificate of formation as amended or restated. (2) "DISTRIBUTION"

Section 25-1-40 Electronic access to wage reports. (a) For purposes of this section, the following
terms have the following meanings: (1) CONSUMER REPORTING AGENCY. Any person, entity, or agency
which, for monetary fees, dues, or on a cooperative nonprofit basis, regularly engages in
whole or in part in the practice of assembling or evaluating consumer credit information or
other information on consumers for the purpose of furnishing consumer reports to third parties,
and which uses any means or facility of interstate commerce for the purpose of preparing or
furnishing consumer reports. (2) DEPARTMENT. The Department of Labor. (3) USER. The same meaning
as set forth in the federal Fair Credit Reporting Act, 15 U.S.C. §1681 et seq. (b) Notwithstanding

any civil action initiated by any party, or pending criminal or civil matter relating to Section
