Section 40-27-1 Compact adopted; terms. The following Multistate Tax Compact is hereby approved,
adopted and enacted into law by the State of Alabama: Multistate Tax Compact Article I. Purposes.
The purposes of this compact are to: 1. Facilitate proper determination of state and local
tax liability of multistate taxpayers, including the equitable apportionment of tax bases
and settlement of apportionment disputes. 2. Promote uniformity or compatibility in significant
components of tax systems. 3. Facilitate taxpayer convenience and compliance in the filing
of tax returns and in other phases of tax administration. 4. Avoid duplicative taxation. Article

Section 7-9A-102 Definitions and index of definitions. (a) Article 9A definitions. In this
article: (1) "Accession" means goods that are physically united with other goods

Section 5-11A-36 "Related" defined. A transferor bank, trust company or trust department
is "related" to a transferee bank, trust company or trust department if: (1) Such
transferee controls the transferor; (2) Such transferor controls the transferee; (3) The same
entity controls, directly or indirectly, the transferor and the transferee; (4) A majority
of the directors of the transferor are directors of the transferee; or (5) A majority of the

Section 5-11A-33 Objection to transfer; hearing on objection; appointment of related institution
as agent. (a) Any person given notice pursuant to Section 5-11A-32 may file a written objection
to the fiduciary transfer with the Superintendent of the State Banking Department, stating
grounds for objection, within 30 days of receipt of notice of the transfer by the person notified
pursuant to Section 5-11A-32. The transferor shall then have 30 days to either: (1) Abandon
the transfer of fiduciary accounts to which objection was given and hold such transfer for
nought, or (2) Apply to the State Banking Department for a hearing on the merits of the objection
to transfer. After such hearing, the State Banking Department shall either approve or deny

Section 19-4-40 Definitions. When used in this article, the following words and phrases shall
have the following meanings, respectively, unless the context clearly indicates otherwise:
(1) FIDUCIARY. An administrator, an administrator with the will annexed, an administrator
de bonis non, an executor, a trustee, a guardian, a conservator, an agent or a custodian.

Section 26-9-4 Limitations as to appointment of guardians. Except as provided in this chapter,
it shall be unlawful for any person to accept appointment as guardian of any ward if such
proposed guardian shall at that time be acting as guardian for five wards. In any case, upon
presentation of a petition by an attorney of the administration under this section alleging
that a guardian is acting in a fiduciary capacity for more than five wards and requesting
his or her discharge for that reason, the court, upon proof substantiating the petition, shall
require a final accounting forthwith from such guardian and shall discharge such guardian
in the case. The limitations of this section shall not apply where the guardian is a bank

Section 27-37-1 Assets - Generally. In any determination of the financial condition of an insurer,
there shall be allowed as assets only such assets as are owned by the insurer and which consist
