Section 45-48-70.50 Powers and duties of chair. The Chair of the Marshall County Commission
shall have the following powers and duties in addition to those as may be otherwise provided
by the laws of this state: (1) All of the powers, duties, limitations, and responsibilities,
with relation to the commission as does the judge of probate with relation to county commissions
under the general laws of this state, except insofar as such powers, duties, limitations,
and responsibilities may be inconsistent with this subpart. (2) Be the presiding officer of
the commission and shall have the same powers as other members of the commission in passing
on all questions that may come before the commission including, but not limited to, the power
to vote. (3) Keep and sign the minutes of the commission and be the custodian thereof which
duties, except for the signing, he or she may delegate to any employee of the commission.

Section 45-48-142.23 Fire protection service fee - Referendum. (a) After the county commission
establishes a fire district, the qualified electors of that district may file a petition,
signed by at least five percent of the qualified electors in the fire district who voted in
the last general election, with the office of the judge of probate who shall then order a
referendum to be held in the fire district on the question of establishing a fire protection
service fee for the fire district. Section 45-48-142.27 shall apply to all elections provided
by this subpart. (b) The petition shall contain the name and description of the fire district
area and shall request the judge of probate to call an election on the following question:
"Do you favor the assessment of a fire service fee in the amount of $ (dollars) a month

Mobile County Commission may create a North Mobile County Volunteer Fire Department Board,

Section 45-13-71 Composition; election by districts. (a) The county commission herein created
shall consist of five members, one of whom shall serve as chairman as hereinafter provided.
(b) The five members of the commission shall be elected from, be a qualified elector of, and
