Section 45-49A-63.40 Period of service. Except as otherwise provided in this part, a member's
service shall be his or her period of service as a uniformed officer as determined in accordance
with the Mobile County Personnel Board rules. Service performed other than as a uniformed
officer shall not be included in a member's service except as provided in Section 45-49A-63.41.

RETIREMENT BENEFIT. A benefit payable pursuant to the terms of subsection (a) of Section 45-37-123.100.
(52) SYSTEM or PLAN. The General Retirement System for Employees of Jefferson County, which
system or plan may sue or be sued, and in such name all of its business shall be transacted.
(53) SPOUSE. The legal wife or husband of a member as determined in accordance with federal

Section 45-49A-63 Definitions. As used in this part, the following words and terms shall have
meanings as follows: (1) ANNUITY STARTING DATE. The first day for which a benefit is payable
as an annuity or any other form under Section 45-49A-63.80. (2) BENEFICIARY. The person or
persons named by a member by written designation filed with the board to receive payments
under this plan after the member's death. The member may not change his or her beneficiary

Section 45-49A-63.42 Restoration of retired member or other former member to service. (a) If
a member entitled to a benefit under Section 45-49A-63.60, Section 45-49A-63.61, or subsection
(a) of Section 45-49A-63.62 of the plan is restored to service as a uniformed officer, any
benefit he or she may be receiving under Subpart 4 shall cease and any election of an optional
benefit in effect shall be void. If he or she is restored to service as a uniformed officer
before he or she has a break in service exceeding one year, any service to which he or she
was entitled when he or she retired or terminated service shall be restored to him or her,
and upon his or her later retirement or termination, his or her benefit shall be based on
the benefit formula then in effect and his or her salary and service before and after his
or her break in service, reduced by an amount that is of equivalent actuarial value to the
benefits he or she received under Section 45-49A-63.60 or subsection (a) of...

Section 36-21-70 Retirement annuity. Any member shall, at any time after reaching the age of
52 and completion of at least 15 years' qualified service or the completion of 25 years of
qualified service, regardless of age, be entitled to an annuity benefit. The amount of the
monthly benefit shall be determined by the board of commissioners in an amount recommended
by the actuary for the fund. The benefit shall begin upon approval by the board on the date
of the member's application for the benefits on forms provided by the board, but in no event
shall the benefit begin prior to his or her termination of service as a peace officer. The
benefits shall be paid for the life of the member, except as otherwise provided in this section.
