Section 45-49-91 Authority to create district. (a) This part shall apply only in Mobile County.
(b) A planning and land use control district may be created pursuant to this part in that
part of Mobile County known as the Fowl River Planning and Land Use Control District, hereinafter
referred to as the district. (c) The term district planning and land use board means the Fowl
River District Planning and Land Use Control Board, hereinafter referred to as the board.
(d) The geographic boundaries of the planning and land use control district created pursuant
to this part shall be the same boundaries as the boundaries of the Fowl River Volunteer Fire

Section 45-49-171 Fees. The Board of Health of Mobile County is hereby authorized to charge
and collect any fee it deems necessary and proper for any service rendered by its officers,
employees, or agents in the performance of duties, functions, and programs required by law
or by regulation or resolution of the county or State Board of Health. The Board of Health
of Mobile County may fix a schedule of fees which shall cover the actual cost or a portion

appointment of a board of adjustment and the regulations and ordinances adopted pursuant to

Section 45-49-142.01 Creation of North Mobile County Volunteer Fire Department Board. (a) The
Mobile County Commission may create a North Mobile County Volunteer Fire Department Board,
hereinafter referred to as the board. (b) The jurisdiction of the board pursuant to this part

Section 45-49-142.04 Billing and collection of service fee. The fire protection and suppression
service fee shall be effective upon adoption by the Mobile County Commission and shall be
billed and collected annually by the Mobile County Revenue Commissioner at the same time and
in the same manner as the ad valorem tax bill of the state. In the event a fire protection
and suppression service fee payable to a volunteer fire department district is assessed and

any county equipment, materials, or supplies or property of any nature in the custody of or
under control of the commission for any kind of work, job, or project on property not owned

Section 45-49-141.01 Financial charge or tax. (a) After the Mobile County Commission has determined
that such a need does exist in Mobile County, the county commission, in the manner hereinafter
specified, may provide for a financial charge or tax to be paid by the owners of forest lands
located in Mobile County for the use of the land for timber growing purposes amounting to
the whole or any part of the cost of such fire protection program, but not in excess of ten
cents ($0.10) per acre, provided such financial charge or tax is not greater than the benefit
