Section 11-97-2 Definitions. The following words and phrases used in this chapter, and others evidently intended as the equivalent thereof, shall, in the absence of a clear implication herein otherwise, be given the following respective interpretations herein: (1) APPLICANT. A natural person who files a written application with the governing body of any county or municipality in accordance with the provisions of Section 11-97-3 hereof. (2) AUTHORIZING RESOLUTION. A resolution of ordinance adopted by the governing body of any county or municipality in accordance with the provisions of Section 11-97-3 hereof, that authorizes the incorporation of a corporation. (3) BOARD. The board of directors of a corporation. (4) BONDS. Bonds, notes, or other obligations representing an obligation to pay money. (5) CORPORATION. (2) Adopt rules establishing requirements and restrictions for the management of solid waste, excluding the collection and transportation of nonhazardous and nonmedical solid waste. Section 45-49-252.07 Storage and containers of solid waste prior to collection. (a) The property owner or occupant shall store solid waste on his or her premises or property or shall require it to be stored or handled in such a manner as to prevent the propagation, or harborage of rats or arthropod vectors or the creation of a sanitary nuisance. (b) All garbage and putrescible matter or mixed garbage and rubbish shall be stored in containers which are nonabsorbent, water-tight, vector resistant, durable, easily cleaned, and designed for safe handling; or in paper or plastic bags having sufficient strength and water tightness and which are designed for proper containment. Section 22-30-5.1 Restriction on number of commercial hazardous waste treatment facilities or disposal sites per county; legislative approval of sites. (a) The term "hazardous waste" shall mean the same as defined by Section 22-30-3(5). Section 22-30E-3 Definitions. Unless otherwise defined in this chapter, the definition of all terms included in Section 22-30-3 shall be applicable to this chapter. Section 45-49-252.06 Collection of solid waste. (a)(1) Only county franchised collectors possessing valid permits shall engage in the business of providing solid waste management services to residential property within the county. Fees for such service shall be established by resolution or ordinance of the Mobile County Commission, consistent with the provisions of franchise agreements. Upon May 3, 1988, any proposed increase in fees charged shall be reviewed and approved in the following manner: a.
