Section 45-49-261.07 Board of adjustment. The Mobile County Commission shall provide for the appointment of a board of adjustment and the regulations and ordinances adopted pursuant to the authority of this part shall provide that the board of adjustment, in appropriate cases and subject to appropriate conditions and safeguards, may make special exceptions to the terms of the ordinances and regulations in harmony with their general purposes and interests and in accordance with general or specific rules therein contained. The board of adjustment shall be appointed by the Mobile County Commission. The board of adjustment shall consist of three members who shall be qualified electors of the planning jurisdiction. Section 45-48-142.23 Fire protection service fee - Referendum. (a) After the county commission establishes a fire district, the qualified electors of that district may file a petition, signed by at least five percent of the qualified electors in the fire district who voted in the last general election, with the office of the judge of probate who shall then order a referendum to be held in the fire district on the question of establishing a fire protection service fee for the fire district. Section 45-48-142.27 shall apply to all elections provided by this subpart. (a) An animal control officer or law enforcement officer of Mobile County shall investigate any incidents involving any dog reported to be dangerous or a nuisance in the unincorporated areas of Mobile County. (b) If a dog, which is unowned and has been reported to be dangerous, bites a person, the dog may be quarantined and destroyed pursuant to subsection of Section 3-7A-9. For purposes of this subsection, bites means the same as has been exposed as defined in subdivision (5) of Section 3-7A-1.
