Section 4-3-5 Board of directors of authority. Each authority shall be governed by a board
of directors of three or more members, selected as provided herein. If the sole authorizing
subdivision is a county, the governing body of said county shall elect all members, the number
of such members to be set out in the certificate of incorporation of said authority. In all
other cases, one member shall be elected by the governing body of each authorizing subdivision,
one member shall be elected by the governing body of the county in which is located the principal
office of the authority specified in the certificate of incorporation, if such county is not
an authorizing subdivision, and one additional member shall be agreed to and elected by the

Section 40-3-2 Selection of members; terms of office. (a) This subsection shall apply to every
county in the state except a county subject to the provisions of subsection (b) of this section.

Elmore County is altered to comply with this section. The governing body shall continue to

Section 45-46-242.26 Charge for collection; disposition of funds. The department, or other
entity, shall charge Marengo County for collecting the tax levied under this subpart in an
amount or percentage of total collections as may be agreed upon by the commissioner, or other
entity, and the Marengo County Commission. The charge shall not exceed five percent of the
total amount of the tax collected in the county. The charge may be deducted each month from
the gross revenues from the tax before certification of the amount of the proceeds due Marengo

Section 16-1-24.3 Local boards of education to implement policies requiring expulsion of students
who possess firearms in school areas. (a) All city and county boards of education shall develop
and implement local policies and procedures requiring the expulsion of students, for a period
of one year, who are determined to have brought to school or have in their possession a firearm
in a school building, on school grounds, on school buses, or at other school-sponsored functions.
Notwithstanding the foregoing, city and county boards of education and the local superintendent
of education of each board may modify the expulsion requirement for a student on a case-by-case
