Section 45-45-20 Licensing requirements; prohibited activities. (a)(1) Pursuant to the
authority granted in Article IV, Section 104 of the Constitution of Alabama of 1901,
now appearing as Section 104 of the Official Recompilation of the Constitution of Alabama
of 1901, as amended, that allows local legislation to regulate or prohibit alcoholic beverage
traffic, any public or private lounge, tavern, bar, club, nightclub, or restaurant, operating
in an unincorporated area of Madison County outside of the police jurisdiction of a municipality,
that features or otherwise permits topless females on its premises shall automatically forfeit
any valid Alcoholic Beverage Control Board license which it has been granted. The term topless

adopted by a simple majority of the entire commission, may do the following: (1) Levy, provide

(a) The Legislature finds that nudity, sexual conduct, and the depiction or simulation thereof
in conjunction with the furnishing of alcoholic beverages in public places is contrary to
the safety, health, and morals of the inhabitants of Calhoun County, Alabama, and is desirous
of prohibiting such conduct. This section is therefore enacted pursuant to the authority
granted in Article IV, Section 104 of the Constitution of Alabama of 1901, that allows

Section 45-45-20.01 Rules and regulations governing liquor traffic; violations. (a)
The Legislature finds that the authority of the Legislature to enact local laws regulating
the liquor traffic is preserved in Section 104 of the Constitution of Alabama of 1901,

Section 45-45-21 Regulation of sale of alcoholic beverages on Sunday. (a)(1) This section
only applies to Madison County. (2) This section applies to the sale of alcoholic beverages
on Sunday by retail licensees of the Alcoholic Beverage Control Board of Alabama. (b)(1) The
governing body of any municipality within the county, by ordinance adopted by a simple majority,
