Section 45-44A-41.01 Resolution. Whenever any such weeds are growing upon any streets or sidewalks or private property the governing body of the City of Tuskegee, by resolution, may declare the same to be a public nuisance. The resolution shall refer to the street by the name under which it is commonly known, and describe the property upon which or in front of which the nuisance exists by giving a legal description thereof, and no other description of the property shall be required. If objections are filed, at the time stated in the notice, the governing body of the municipality shall hear and consider all evidence, objections, and protests regarding the proposed removal of weeds. The governing body of the municipality may continue the hearing from time to time. Whenever the appropriate city official of the city shall find that any building, structure, part of building or structure, party wall, foundation, abandoned or unused swimming pools, or abandoned wells or cisterns situated in the city is unsafe to the extent that it is a public nuisance, the official shall report the findings to the city governing body.
