(a) When not otherwise provided by law, the Commissioner of Agriculture and Industries within the state, the county sealer within the county and the city sealer within the city shall have the power and it shall be their duty to inspect, test, try, and ascertain if they are correct all weights, measures, and weighing or measuring devices kept, offered, or exposed for sale, sold, used, or employed in proving the size, quantity, extent, area, or measurement of quantities, things, produce, or articles for distribution or consumption purchased or offered or submitted for sale, hire, or reward, in computing any charge for services rendered on the basis of weight or measure or in determining weight or measure when a charge is made for such determination. Section 11-3A-2 Powers for public welfare, health, and safety; authorization; scope. Section 22-18-9 Criminal history background checks. (a) When reviewing an applicant for initial licensure under this article, the Board of Health may require a fingerprint-based state and national criminal background check through the Alabama State Law Enforcement Agency for purposes of determining the applicant's suitability for licensure. (b) The applicant shall pay all costs associated with a required criminal background check at the same time the applicant pays the initial licensure fee. (c) Upon receipt of an authorized request and payment from the board, the Alabama State Law Enforcement Agency shall promptly cause the criminal background check to be conducted and return the results directly to the board.
