Section 32-5A-152 Moving heavy equipment at railroad grade crossings. (a) No person shall operate
or move any crawler-type tractor, steam shovel, derrick, roller, or any equipment or structure
having a normal operating speed of 10 or less miles per hour or a vertical body or load clearance
of less than one-half inch per foot of the distance between any two adjacent axles or in any
event of less than nine inches, measured above the level surface of a roadway, upon or across
any tracks at a railroad grade crossing without first complying with this section. (b) Before
making any such crossing the person operating or moving any such vehicle or equipment shall
first stop the same not less than 15 feet nor more than 50 feet from the nearest rail of such

Section 32-8-84 Unclaimed motor vehicles; suspension of registration of stolen or converted
vehicles. (a) The following shall be considered an unclaimed motor vehicle: (1) A motor vehicle
left unattended on a public road or highway for more than 48 hours. (2) A motor vehicle, not
left on private property for repairs, that has remained on private or other public property
for a period of more than 48 hours without the consent of the owner or lessee of the property.
(3) A motor vehicle, left on private property for repairs, that has not been reclaimed within
48 hours from the latter of either the date the repairs were completed or the agreed upon

Section 6-5-701 Reliance upon specifications. A contractor is justified ordinarily in relying
upon the specifications that are contained in the contract with an awarding authority. No
contractor shall be held civilly liable for work performed on a highway, road, bridge, or
street including repairs, construction, or maintenance on behalf of the awarding authority
unless it is shown by a preponderance of the evidence that physical injury, property damage,
or death is proximately caused by any of the following: (1) A failure by the contractor to

Section 11-49-3 Railroads and public utilities using streets to be required to keep streets
in repair, etc. Street and other railroad companies shall be required to keep their tracks
in repair, using such rails as may be prescribed, and shall maintain and keep in repair the

Section 11-49-6 Vacation of right-of-way fee. Prior to the exercise of the power of a municipality
incorporated in this state to vacate the public right-of-way for a road, street, alley, or
other dedicated public way, open or unopen, as a condition of exercise of such power to vacate,
the governing body may require abutting landowners who will directly benefit from such vacation
to pay to such municipality a vacation of right-of-way fee equal to the fair market value
of the land which will be added to the holdings of such abutting landowners. Such fair market
