Section 45-37A-100.09 Late fees; record of civil violations. The city may provide by ordinance
that late fees not exceeding twenty-five dollars ($25) shall attach to untimely paid fines
that are authorized pursuant this article and imposed pursuant to this article. No person
may be arrested or incarcerated for nonpayment of a fine or late fee. No record of an adjudication
of civil violation made under this article shall be listed, entered, or reported on any criminal
record or driving record, whether the record is maintained by the city or an outside agency.
An adjudication of civil violation provided for in this article shall not be considered a
conviction for any purpose, shall not be used to increase or enhance punishment for any subsequent
offense of a criminal nature, shall not be considered a moving violation, and shall not be

Section 45-37A-331.02 Definitions. As used in this part, the following terms shall have the
following meanings: (1) CITY. The City of Midfield, Alabama. (2) CIVIL FINE. The monetary
amount assessed by the city pursuant to this part for an adjudication of civil liability for
a traffic signal violation, including municipal court costs associated with the infraction.
(3) CIVIL VIOLATION. There is hereby created a noncriminal category of state law called a
civil violation created and existing for the sole purpose of carrying out the terms of this
part. The penalty for violation of a civil violation shall be the payment of a civil fine,
the enforceability of which shall be accomplished through civil action. The prosecution of
a civil violation created hereby shall carry reduced evidentiary requirements and burden of

Section 45-41A-41.04 Notice of violation. (a) Prior to imposing a civil penalty under this
part, the city shall first mail via first class United States mail a notice of violation to
the owner of the motor vehicle which is recorded by the photographic traffic signal enforcement

Section 16-27A-7 Contesting a notice of violation; adjudication. (a) No person shall be responsible
for payment of a civil fine for a notice of violation issued under this chapter if the operator
of the vehicle that is the subject of the notice of violation is adjudicated to have not committed
a violation or there is otherwise a lawful determination that no civil penalty may be imposed.

or lease of real property or any interest therein of the state made in violation of this article
shall be null and void, and the person or persons violating this article shall be subject
