Section 40-23-4 Exemptions. (a) There are exempted from the provisions of this division and
from the computation of the amount of the tax levied, assessed, or payable under this division
the following: (1) The gross proceeds of the sales of lubricating oil and gasoline as defined
in Sections 40-17-30 and 40-17-170 and the gross proceeds from those sales of lubricating
oil destined for out-of-state use which are transacted in a manner whereby an out-of-state
purchaser takes delivery of such oil at a distributor's plant within this state and transports
it out-of-state, which are otherwise taxed. (2) The gross proceeds of the sale, or sales,
of fertilizer when used for agricultural purposes. The word "fertilizer" shall not
be construed to include cottonseed meal, when not in combination with other materials. (3)
The gross proceeds of the sale, or sales, of seeds for planting purposes and baby chicks and

diversion program. (b) All discretionary powers endowed by a common law and provided by statutes

Section 12-14-54 Certification program; continuing education requirements. (a) Each municipal
court clerk, within six months after taking office, shall enroll in a municipal court magistrates'
certification program approved by the Administrative Director of Courts. Each municipal court
magistrate who is not a municipal court clerk shall enroll in the certification program not
later than six months from the date of his or her appointment. Each municipal court magistrate
and municipal court clerk shall complete the program in the manner and within the time prescribed
by the director and the Administrative Office of Courts. The director shall appoint a Municipal
Magistrates' Certification Program Oversight Committee which shall make educational recommendations

Section 12-15-203 Transfer of cases from juvenile court. (a) A prosecutor, before a hearing
on a delinquency petition on its merits and after notifying, verbally or in writing, the juvenile
probation officer, may file a motion requesting the juvenile court judge to transfer a child
for criminal prosecution to the circuit or district court, if the child was 14 or more years
of age at the time of the conduct charged and is alleged to have committed an act which would
constitute a criminal offense as defined by this code if committed by an adult. (b) The juvenile
court judge shall conduct a hearing on all motions for the purpose of determining whether
it is in the best interests of the child or the public to grant the motion. Only if there
