Section 45-46-84.01 Special court filing fee. (a) In Marengo County, a special court filing
fee of ten dollars ($10) shall be collected by the judge of probate on all petitions that
initiate a judicial proceeding in the probate court of the county. The special court filing
fee shall be in addition to all other filing fees required by law to be collected. (b) The
judge of probate shall deposit all funds collected into a special fund to be maintained by
the judge of probate for improved recording, archiving, Internet technology, preservation,
and retrieving of records and other equipment, maintenance, training, and services necessary
for the improvement of the recording, court, and license divisions of the office of the judge
of probate. (c) This section is cumulative. Nothing contained in this section shall alter
or change an existing law relating to charges and fees to be collected by the Judge of Probate

Section 12-23A-4 Establishment of drug court; participation; incentives and sanctions; components;
drug court team and advisory committee; coordinator. (a)(1) The presiding judge of each judicial
circuit, with the consent of the district attorney of that judicial circuit, may establish

(1) The Madison County Judicial System faces a severe crisis. The Twenty-third Judicial Circuit
has the highest caseload in Alabama. The number of criminal cases has doubled during the last
five years, resulting in a backlog of almost 4,500 cases, including approximately 18 capital
murder cases. Some defendants have been awaiting trial for almost five years. The caseload
facing prosecutors is staggering. Individual drug crime prosecutors are assigned in excess
of 500 cases and it is not uncommon for each prosecutor to prepare to try 60 cases on a single
week's docket. The sheer number of criminal defendants is so large that judges cannot bring
them all into the courtroom without violating an order of the Madison County Fire Marshal.

Section 12-18-133 Purchase of additional credit. Any justice of the Supreme Court, judge of
the Court of Civil Appeals, judge of the Court of Criminal Appeals, circuit judge, or district
judge who has 24 years of creditable service in the Judicial Retirement Fund of Alabama may
elect to purchase credit in the Judicial Retirement Fund of Alabama for up to one additional
year. Any justice or judge eligible to purchase such credit shall be awarded such credit provided
that the justice or judge shall pay into the Judicial Retirement Fund of Alabama a sum of
money which is equal to the annual contribution of both the justice or judge and the annual
contribution of the state into the fund at the time of election to purchase the credit multiplied

to provide a special fund for the creation and maintenance of the library and for the purposes
of judicial administration as further specified in this subpart, there shall be taxed as costs
