Section 45-49-101.10 Civil violations under part. (a) A civil violation of this part may not result in any punishment of a criminal nature, may not count as points and may not be entered into any person's official driving history, may not be considered a criminal conviction for any purpose, may not be used to increase or enhance punishment for a subsequent offense of a civil or criminal nature, and may not be considered a moving violation, and no person may be arrested or incarcerated for nonpayment of a civil fine. (b) The fact that a person is held liable or responsible for a civil fine for a violation may not be used as evidence that the person was guilty of negligence or other culpable conduct, but this fact may not preclude evidence generated by a device from being used as evidence in other proceedings. (a) The city is empowered to utilize an automated photographic traffic signal enforcement system to detect and record traffic signal violations, to issue notices of civil violations by mail, and to prosecute civil violations for the recorded traffic signal violations which may occur within the corporate limits of the city as provided in this part. Section 45-45-174 Noise control. (a) In Madison County, the Madison County Commission may enact a noise ordinance for the areas outside of the corporate limits of any municipality and may provide that a violation of the ordinance constitutes a public nuisance subject to a civil fine of not more than one thousand dollars ($1,000) per day to be assessed as provided in the ordinance. Any law enforcement officer or constable may issue a citation alleging a violation of the ordinance. Section 45-5-244 Levy of tobacco tax; use of proceeds; violations. (a) The County Commission of Blount County may levy a county privilege or excise tax on every person, firm, or corporation that sells, delivers, uses, or otherwise consumes tobacco products in the county. Tobacco products include cigarettes, cigars, smoking tobacco, chewing tobacco, snuff, and tobacco paper, both gummed and ungummed, or packages thereof.
