Section 13A-6-60 Definitions. The following definitions apply in this article: (1) FORCIBLE COMPULSION. Use or threatened use, whether express or implied, of physical force, violence, confinement, restraint, physical injury, or death to the threatened person or to another person. Factors to be considered in determining an implied threat include, but are not limited to, the respective ages and sizes of the victim and the accused; the respective mental and physical conditions of the victim and the accused; the atmosphere and physical setting in which the incident was alleged to have taken place; the extent to which the accused may have been in a position of authority, domination, or custodial control over the victim; or whether the victim was under duress. Forcible compulsion does not require proof of resistance by the victim. (2) INCAPACITATED. The term includes any of the following: a. Section 11-20-74 Borrowing of money; security. (a) Subject to the conditions, qualifications, and restrictions set forth in subsection (b), an agriculture authority may borrow money from any person or governmental entity. Section 34-1A-7 Licenses - Required. (a) Effective January 1, 1998, it shall be unlawful for any person or business entity to engage in a business regulated by this chapter in this state without a current valid license or in violation of this chapter and applicable rules and regulations of the board. (b) Effective January 1, 1998, it shall be unlawful for a person or business entity not licensed under this chapter to advertise or hold out to the public that he or she is a licensee of the board. Section 45-49-50 Qualifications, Constable Regulatory Board of Mobile; suspensions. (a) In Mobile County, no person shall hold the office of constable unless the person has successfully completed the minimum standards and training for peace officers pursuant to Section 36-21-46. (b) All constables shall be required to obtain a minimum of 20 hours of training per year, in addition to those requirements for constables set forth in subsection (a). (c) Constables not acquiring the required amount of training hours may not perform the duties of their office until the required training has been met. (a) An operator's license issued under this chapter, whether for horse racing and pari-mutuel wagering thereon or for greyhound racing and pari-mutuel wagering thereon, shall be for an initial period of 20 years, but shall be subject to renewal as provided in this section.
