Section 45-21-84.30 Purpose. This subpart shall apply only in Crenshaw County. The purpose
of the subpart is to facilitate the use of public records in property transactions in Crenshaw
County by providing for the installation of an improved system of recording, archiving, and
retrieving instruments and documents affecting the title to real and personal property that
are recorded in the office of the judge of probate, and for the recording, archiving, and
retrieving of other instruments, documents, and other uses in the discretion of the judge

Section 45-30-82.21 Definitions. The following words and phrases, including the plural of any
thereof, whenever used in this subpart, shall have the following respective meanings: (1)
GENERAL PROPERTY INSTRUMENT. A real property instrument that affects the title to personal
property as well as real property. (2) IMPROVED RECORDING SYSTEM. A system of recording, archiving,
and retrieving real property, personal property instruments, and probate court documents under
the jurisdiction of the judge of probate, and in the discretion of the judge of probate, or
recording, archiving, and retrieving other instruments and documents, which system when completed,
shall consist of equipment necessary and suitable to record, archive, and retrieve records.

Section 45-46-84 Special index fee. (a) In Marengo County, a special index fee of five dollars
($5) shall be collected by the judge of probate on each real or personal property instrument,
or other instrument recorded or filed for record in the probate court of the county. The special
index fees shall be in addition to all other fees, taxes, and other charges required by law
