Section 40-6-2 Oath; assumption of duties, etc., in case of vacancy. Such supernumerary tax
collector, tax assessor, license commissioner, or other elected official charged with the
assessment and/or collection of any ad valorem taxes in the various counties of the State
of Alabama shall take the oath of office prescribed for tax collectors, tax assessors, license
commissioners, or other elected officials charged with the assessment and/or collection of
any ad valorem taxes in this state; and, if a vacancy shall occur in the office in the county
in which the supernumerary tax collector, tax assessor, license commissioner, or other elected
official charged with the assessment and/or collection of any ad valorem taxes holds his commission,
he shall immediately assume and exercise all of the duties, power, and authority of such official
in said county until a successor is appointed by the Governor of the State of Alabama. (Acts

Section 11-51-183 Certification and disposition of taxes; charge for collection and administration;
redistribution of over-charges; warrant; fees. (a) The Commissioner of Revenue shall deposit
into the State Treasury all municipal taxes collected by the department under this division;
and, on a bi-weekly basis, the commissioner shall certify to the Comptroller the amount of
taxes collected under the provisions of this division for the approximate two-week period
immediately preceding the certification and the amount to be distributed to each municipality,
less collection and administration charges deducted, which shall be paid to the treasurer
or other custodian of funds of the municipality within three days after certification thereof.
(b) The Department of Revenue shall charge each municipality its actual cost for collecting

Section 45-43-246.87 Charge for collection. The collection agency may charge Lowndes County
for collecting the tax levied pursuant to this subpart in an amount or percentage of total
collections as may be agreed upon by the collection agency and the Lowndes County Commission.
The charge shall not exceed five percent of the total amount of the tax collected in the county.
The charge may be deducted each month from the gross revenues from the tax before certification
of the amount of the proceeds due Lowndes County for that month. The collection agency shall
pay into the Lowndes County General Fund all amounts collected under this subpart, as the
tax is received by the collection agency on or before the first day of each successive month.
