Section 45-49-142.05 Disposition of funds. The proceeds of the fire protection and suppression
service fee levied shall be paid into the Mobile County General Fund. The Mobile County Commission
may retain two percent of the funds to cover the cost of administration of the program and
also an additional two percent shall be held by the county commission in a segregated account
for future unexpected expenses of the volunteer fire departments covered under this part.

Section 9-3-17 Certification as volunteer fire department. (a) The term volunteer fire department
shall apply to and be used to define an organized group of area residents who meet the following
requirements for personnel, training, and equipment: (1) The group shall be organized and
incorporated under the laws of the State of Alabama as a nonprofit organization or as an authority
of a municipality, fire district, or other legal subdivision. The group shall actively respond
to fires and other emergencies and shall have a clearly defined coverage area recognized by
the Alabama Forestry Commission and the county fire association where the group is located

this part, an eligible fire department means a fire department in Crenshaw County that maintains

Section 45-45-175.01 Location - Proximity to fire department. (a)(1) In Madison County, any
petroleum product tank farm shall be within five miles of and served by a full-time paid fire
department. The site of any petroleum product tank farm shall be approved by resolution of
the county commission if located outside of the corporate limits of a municipality or by either
resolution of the municipal governing body or by compliance with applicable zoning laws if
located within the corporate limits of a municipality. The petroleum product tank farm operator

The fire protection service fee shall be collected, administered, and enforced as closely
as possible at the same time, in the same manner, and under the same requirements and laws
as are the ad valorem taxes of the state. The proceeds of the fee shall be paid into a special

shall only be expended for fire protection purposes, including training, supplies, and equipment.
The funds may also be expended to purchase liability insurance to insure coverage of acts

Section 45-3-140.07 Transfer of funds upon dissolution or abandonment of volunteer fire department.
Upon dissolution or abandonment of any eligible volunteer fire department, any remaining funds
derived from this article or any assets purchased with funds derived from this article, after
all lawful indebtedness has been satisfied, shall be transferred to the county commission.
