Section 41-9-646 Purging, modification, or supplementation of criminal records - Court order; notification. Should the record in question be found to be inaccurate, incomplete, or misleading, the court shall order it to be appropriately purged, modified, or supplemented by an explanatory notation. Each agency or individual in the state with custody, possession, or control of any record shall promptly alter every copy in its custody, possession, or control in accordance with a court order. Notification of each deletion, amendment, and supplementary notation shall be promptly disseminated to any individuals or agencies to which the records in question have been communicated, including ALEA, and to the individual whose records have been ordered to be altered. To increase public confidence in the fairness of the state tax system, the state shall provide an independent agency with tax expertise to resolve disputes between the Department of Revenue and taxpayers, prior to requiring the payment of the amounts in issue or the posting of a bond, but after the taxpayer has had a full opportunity to attempt settlement with the Department of Revenue based, among other things, on the hazards of litigation. (a) All persons convicted of a criminal offense as set out in Section 36-18-24 shall, when requested by the director submit to the taking of a DNA sample or samples as may be specified by the director, provided, however, the director shall promulgate such rules and regulations as may be necessary for the purposes of ensuring that DNA samples are collected in a medically approved manner.
