Section 32-9B-7 Teleoperation systems; Requirements. A commercial motor vehicle equipped with
a teleoperation system registered in this state shall meet all of the following requirements:
(1) Is in compliance with applicable federal law. (2) Is certified in accordance with federal
regulations in 49 C.F.R. Part 567 as being in compliance with applicable federal motor vehicle
safety standards and shall bear the required certification label or labels, including reference
to any exemption granted under applicable federal law. (3) Is capable of being operated in
compliance with the applicable traffic and motor vehicle laws of this state, regardless of

Section 32-5B-4 Safety belt requirements for occupants of passenger cars; exemptions. (a)(1)
Each occupant of a passenger car manufactured with safety belts in compliance with Federal
Motor Vehicle Safety Standard No. 208 shall have a safety belt properly fastened about his
or her body at all times when the vehicle is in motion. (2) An adult occupant of a passenger
car in violation of subdivision (1) shall be the proper person to be charged with the violation.
(3) Notwithstanding any other provision of this section, a violation of this section in any
seat other than a front seat of a vehicle shall be a secondary violation after a lawful stop
of the vehicle based on probable cause of another violation of law and the issuance of a citation

Section 12-14-91 Admittance into program; completion of program; eligibility; liability under
program. (a) A person charged with a criminal offense under the jurisdiction of the municipal
court in a municipality that has established a pretrial diversion program may apply to the
court for admittance to the program. (b) Upon receipt of the application and recommendation
of the municipal prosecutor, the judge shall determine whether to grant the individual admittance
to the program. (c) Upon admittance to the program, the individual shall be required to enter
a plea of guilty at which time the case shall be placed in an administrative docket until
such time as the offender has completed all requirements of the pretrial diversion program.
Imposition of any sentence shall be deferred until such time as the offender completes the
