Section 40-2A-17 Allocation , etc., of gross income, deductions, etc., between entities
controlled by the same interests; improper contingent fees. For purposes of the tax imposed
in Chapter 18 of this title, the following rules shall apply: (a) In any case of two or more
organizations, trades, or businesses (whether or not affiliated within the meaning of 26 U.S.C.
§ 1504) owned or controlled directly or indirectly by the same interests, the Commissioner
of the Alabama Department of Revenue may distribute, apportion, or allocate gross income,
deductions, credits, or allowances, if the commissioner determines that such distribution,
apportionment, or allocation is necessary in order to prevent evasion of Alabama income taxes

Section 40-7-21 Failure to fill out schedules or lists or give information or subscribe
oaths; authority for enforcement of imposed taxes. (a) It shall be a Class C misdemeanor for
any taxpayer, or attorney or agent of any taxpayer having authority to make tax returns, to
fail, neglect, or refuse on demand of the tax assessor, county revenue commissioner, or other

Section 45-10-244.08 Charge of State Department of Revenue: its disposition of tax proceeds.
The State Department of Revenue shall charge the county, for collecting the taxes authorized
to be levied herein, the costs of the department in collecting the taxes; provided such charge
shall not, in any event, exceed five percent of the total amount of the taxes collected hereunder.
Such charge for collecting the taxes for the county may be deducted each month from the tax

Section 11-3-11.2 Collection of local taxes - County commission. (a) The county commission
may, by ordinance or resolution, administer and collect, or contract for the collection of,
any local sales and use taxes or other local county taxes levied or authorized to be levied

Section 11-51-90 Municipal business licenses; branch offices; application. (a) All municipalities
shall have the following powers: (1) To license any exhibition, trade, business, vocation,
occupation, or profession not prohibited by the Constitution or laws of the state which may
