Section 40-23-62 Exemptions. The storage, use, or other consumption in this state of the following tangible personal property is hereby specifically exempted from the tax imposed by this article: (1) Property, on which the sales tax imposed by the provisions of Article 1 of this chapter is paid by the consumer to a person licensed under the provisions of Article 1 of this chapter. (2) Tangible personal property, not to be used in the performance of a contract, brought into this state by a nonresident thereof for his or her own storage, use, or consumption while temporarily within this state. (3) In addition to the exemptions provided in subdivisions (1) and (2), all exemptions enumerated in Sections 40-23-4(a) and 40-23-4.1 are incorporated by reference in this section. (a) There are exempted from the provisions of this division and from the computation of the amount of the tax levied, assessed, or payable under this division the following: (1) The gross proceeds of the sales of lubricating oil and gasoline as defined in Sections 40-17-30 and 40-17-170 and the gross proceeds from those sales of lubricating oil destined for out-of-state use which are transacted in a manner whereby an out-of-state purchaser takes delivery of such oil at a distributor's plant within this state and transports it out-of-state, which are otherwise taxed.
